Terms of Use

1. The agreement

These Terms are between you and Mohammad Oumari (“we”, “us”). The App is also licensed to you under Apple’s Licensed Application End User License Agreement (the “Apple EULA”). If these Terms and the Apple EULA conflict, these Terms apply to the extent the Apple EULA allows.

2. Your license

We grant you a personal, non-exclusive, non-transferable license to use the App on Apple devices you own or control, as allowed by the App Store’s Usage Rules. You may not copy, modify, reverse engineer, resell or redistribute the App, except where the law allows it.

3. Your content

You own the videos, photos, audio, text and other material you add to or create with the App (“Your Content”). We don’t receive it and claim no rights in it. Because Your Content stays on your device, you are responsible for backing it up; deleting the App deletes its projects.

You are responsible for Your Content and for having the rights to use any material you include, such as music, footage, images or fonts. Don’t use the App to create content that is illegal, infringes someone else’s rights, or harms others.

4. Material included in the App

The App includes built-in material such as music, sound effects, filters, transitions, animations and fonts. You may use it in videos you make with the App, including videos you publish or use commercially. You may not extract it and distribute it on its own or as part of another library or product.

5. Cutomi Pro subscriptions

• Every tool can be used in the editor for free. A Cutomi Pro subscription is required to export videos that use Pro features.
• Cutomi Pro is offered as an auto-renewing monthly or yearly subscription. Prices are shown in the App before you buy and may vary by country.
• Payment is charged to your Apple Account when you confirm the purchase.
• The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel your subscription in your iPhone’s Settings → your name → Subscriptions. Cancelling stops the next renewal; you keep Pro until the paid period ends.
• If a free trial is offered, any unused part of it ends when you buy a subscription.
• Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.

Videos you exported while subscribed remain yours to use after your subscription ends.

6. Changes to the App

We work to improve the App and may add, change or remove features. We may also change which features are part of Cutomi Pro. We won’t remove access to Pro features you have paid for during a current subscription period without a reasonable replacement or a pro-rated remedy where the law requires it.

7. Privacy

Our Privacy Policy explains what information the App collects and how it is used.

8. Disclaimer

The App is provided “as is” and “as available”. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don’t promise that the App will be error-free or that it will never lose data.

9. Limitation of liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, content or profits, arising from your use of the App. Our total liability for any claim is limited to the amount you paid us for the App in the 12 months before the claim. Some places don’t allow these limits, so they may not apply to you. Nothing in these Terms limits rights you have as a consumer that cannot be waived.

10. Ending these Terms

You can stop using the App at any time by deleting it. If you seriously breach these Terms, your license to use the App ends. Sections 3, 4, 8, 9 and 11 continue to apply after the Terms end.

11. Governing law

These Terms are governed by the laws of Austria, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.

12. Changes to these Terms

We may update these Terms. When we do, we’ll change the date at the top of this page. If you keep using the App after an update, the new Terms apply.
